Its been 2 years since the trial thingee. I didn't know there is still some interest in the same.
Here is an excerpt from the original charge sheet as put up by the so called Dream Team 4.
I quote
“1. Plaintiff (Nances) IS informed, believes, and theron alleges that Defendant Secretatiat (also known as) Sea Biscuit by vertue of access to internet chat forums engaged in a civil attack of defamation against Plaintiff's Dan Nances, Scott Nances, during a period of time between 2009 up until present 2011.”
We also contend that Sea Biscuit aka Secretariat would still be attacking the nances on the forum known as Barntowire if not for the administrator of that forum putting a block against the name Nances and all things Nances. “
Please note that the Dream Team 4 lawyers were poor spellers as they miss-spelled the word "virtue"
Some excerpts from 'My Last Post' thread posted just before I left the forum.
Dan’s prowess as a handicapperThere are plenty of good cappers at BUVS but Dan is probably not one of them. I am sure there are many here who would disagree with me and thats OK. Its my opinion only. In the first three weeks of the contest the Nances Team could not pick one darn winner. Wow!!! Some cappers. It got so bad that 3 wide stopped putting up their totals for fear of embarrassing these two so called super handicappers.
LiarThis guy is a habitual liar. I was taken aback when he admitted to lying in the Pigland thread. This is what he said and I quote”
“When he sent me my $900 I figured he was a straight up guy so I played along with him
lying to everyone saying he is my best customer”.
He also lied about USTA not keeping records prior to 1990 and he himself put up a Sportman’s Park trainer and driver listing dated 1985. Man what a booboo. When I asked him about this discrepancy of course there was no answer forthcoming.
He also lied at Plo p which is commonly known as the Quali-gate affair. Dan openly lied about watching qualifiers at the Meadowland when there was none available to watch. He became the laughing stock of the whole forum.
This guy lies and lies and as all liars he gets his foot gets his foot caught in his mouth.
Infringement of Copyright laws.Yes Dan was guilty of that.He was putting up links for free programs from TM , Once again it was I who stood up and warned him about violating copyright laws. That post too was instantly taken down and the infringement continued. TM returned the favor in kind and deleted all his accounts and then he got a stern warning from the USTA lawyers which made him stop putting up links on his site. Since then this idiot has a vendetta going against TM. Hello there you were the one who was infringing copyright laws and not TM. What did Dan expect TM to do, pat him on the back?
Once I put up a thread quoting Pandy well known author and writer of harness books and harness software. That thread was immediately deleted just because Pandy was associated with USTA and he has this vendetta going against USTA since he got that warning and his accounts deleted. I recently saw one post by Pandy himself on the Meadolands Pace pick thread at BUVS. His post was deleted and he was probably banished from the site. Go figure this one out. Banning a person like Pandy instead of welcoming him with open arms.
When my thread was deleted Dan sends me this PM and I quote:
“Don't get mad about it but I'm removing your topic about Pandy. Nobody affiliated with trackmaster gets any press here.
Those fu ck ers closed both of our accounts and sent a threatening letter saying we were violating copyright laws. Then they had the USTA contact our webhost and try and get us in trouble when we were giving away FREE programs. Fck trackmaster and Pandy.”
Master Chemists and the Elephant Juice.
I was once doing a research on the drug called Etorphine commonly known as the Elephant juice, and I came across this report quite by accident. In the mid eighties there was no test available for this drug and these two master chemists known as Dan and Scott Nances were indiscriminately using this drug knowing full well that currently there was no testing procedure in place for this drug. God only knows how many horses they must have put in the winners circle with Etorphine injected in them. Unbeknownst to them (Nances Bros) there was work in progress to find the fingerprint of this elusive drug. Once they found the finger print and a testing procedure was in place for Etorphine they found not one or two but 9 horses belonging to Scott Nances stable with high doses of Etorphine injected into them and one belonged to the Dan Nances stable.
Scott Nances was banned for life and Dan was given one year as punishment.
http://articles.chicagotribune.com/1985-06-18/sports/8502080883_1_drug-testing-illinois-racing-board-maywood-parkPs: In the end the Nances fought with each other bitterly sending their forum into oblivion.
Now Nances is back posting at Pl op under a hidden screen name.Guess which one.
If you guessed 'Sea Biscuit' you would be right.
Maybe some legal experts can chime in, however, this looks like it was a very high profile case, almost like OJ and Scott Peterson. It's not often cases are brought out of jurisdiction and handed over to a Michigan judge.
