One of the restaurant's other spokesperson died at 29 last year - he was something like 500 lbs.

Now the big question: Is there a legitimate lawsuit against the Grill? 

Initially you'd say "no way" but then you have the tobacco industry with all of it's warning labels & they were found to be liable.
