(Regarding incidents during and after Breeders’ Cup Marathon)

“We conducted a hearing this morning (Saturday). The three jockeys involved, (Calvin) Borel, (Javier) Castellano and (Martin) Garcia were present. We reviewed the films and listened to their explanation on what occurred during the running of the race. The stewards will make a decision on Saturday, today, on what the penalty is going to be. We will write out a formal ruling on Sunday Nov. 7th and apply what penalty we think is appropriate.

“We have scheduled a formal hearing and notified the participants involved in the post race incident. The hearing will be conducted here at Churchill Downs in the stewards’ office on the 13th of November at 9 a.m. We have basically given them the paperwork to confirm that, as by rule. They (Borel and Castellano) have indicated that they will refuse the formal hearing, and when we receive the paperwork on that, we will execute a ruling with the penalties involved.

“By rule and regulation, we have to give them five days notice on the scheduling of a hearing to give them adequate time to prepare whatever defense they wanted, and to notify whichever representatives they wanted.

“They have indicated to us that they will drop their request for a formal hearing and we will proceed with making a determination of what the penalties will be.”


(Regarding Life At Ten in the Breeders’ Cup Ladies’ Classic)

“We are looking into what occurred in the 10th race on Nov. 5 (Ladies’ Classic) and we will contact jockey John Velazquez and trainer Todd Pletcher to get as much information as we possibly can about the performance of that filly in the race.”
