I hope some of you guys can answer this question....my friend has a yearling filly  by Spanish Steps (full to Unbridled's Song)...she shipped her mare to Fla in late fall '07 to be bred to 'Steps' in early '08....the stud fee was 10k and included the resulting foal being BC registered....she finds out yest that the filly is not BC reg. because Steps owner failed to make the BC eligibility payments for '08 and '09 so all foals born in '09 and this yr are not BC reg....this filly is going to the fasig-tipton Keeneland sale in the fall.....she wants to know how much not being BC reg will affect her auction price value ...she is a NYBRED.....I say that if she is good enuff a race horse to GET to the BC, the owners can afford to supplement her....but that's not the point.....will it affect her value? and does my friend have any recourse with the stud owner for a partial stud fee refund as he downright lied about the stud's eligibility? it's just so true....race horse people....90% are shysters...10% are honest.....very sad.....I hope you guys can help with this question! If you believe the Breeders Cup's self promotion on their website, nomination is worth 6x the price of a non-nominated foal.  Unfortunately it appears it would cost at least $100k to nominate the yearling as a horse of racing age.  There was a late nomination fee of $1500 but the deadline for that was December 15th of the year of birth.

If your friend has it in writing that the foal would be BC nominated, I'm sure there would be attorneys out there willing to take the case.
