Today (Saturday) at Tampa Bay Downs Jose C. Ferrer rode a winner in the 5f turf race for Mike Dini. Dini was in the winners circle too - I think it was him.
I thought Ferrer was suspended? Or is he still fighting an appeal?

He appealed. His hearing is Tuesday December 12.

They'll all honor the suspension once it is out of appeal...which should be Tuesday.

Battled, I just called Calder racing office at 305-625-1311 (then press 2) and they told me they will not honor the suspension and don't even honor Illinois finger print cards. It can influence them about issuing a license if he does not have one already. They said it is a local matter.

Not really, just curious. Would rather see a written ruling since hearsay don't mean nothing.

Section 1322.30 Definition of Suspension Whenever the penalty of suspension is prescribed in these rules, it shall be construed to mean an unconditional exclusion and disqualification from the time of receipt of written notice of suspension from privileges and uses of the course and grounds of a track during the progress of a race meeting, unless otherwise specifically limited when such suspension is imposed, such as a suspension from driving. A suspension or expulsion of either a husband or wife shall apply in each instance to both the husband and wife. The suspension becomes effective when notice is given unless otherwise specified

Sway,
What do harness rules have to do with Ferrer? You need to look at the rules that start with 1402 for Thoroughbred racing.

I did and they only talk about suspensions in the 1300's that I could find. Instead of just putting in your 2 cents worth to say I was in the harness rules why don't you throw in your whole nickel's worth and say wether I am right or not about Florida since you are the so called expert!!

It's a moot point at the moment as Ferrer is not suspended at the moment since he has a stay from the Circuit Court. Once his case is adjudicated and the days re-issued, they'll be honored throught the US

Thats not what the people in Florida were saying. Show me the ruling that states the Illinois Racing Board or Illinois stewards have the right to serve penalties outside this state.

jrstark does the cat got your tongue? Your buddy Thomas Graham carries no weight with his comment. You apparently explored the rules section so show us what you found!! If Ferrer does not serve his suspension Illinois can refuse him a license in the future but they cannot impose their will on another state which they have no jurisdiction.

When is this case going to be "adjudicated"? I was not aware this was a judicial case? I assumed he was waiting for hearing before the racing board on 12/12/06. One last thing, which circuit court issued a stay? I could not find anything in the Cook County circuit court.

I wasn't sure either except I learned a long time ago to check for accuracy instead of taking somones word for it on a message board. A question was raised and I just wanted a true answer.
